This Privacy Policy describes how Dempsi (“we”, “us”, and “our”) collects, uses, and shares your personal information when you use our people’s choice voting platform, including our website, voting pages, text-message notifications, and related services (collectively, the “Service”). By using the Service, you agree to the collection and use of information in accordance with this policy.

SECTION 1 - WHO WE ARE AND WHO THIS POLICY COVERS

Dempsi provides a platform on which organizers (“Directors”) create voting competitions, and audiences pay to vote for contestants. This policy applies to three groups of people: Directors who create and manage contests, contestants who are entered into contests, and voters who participate in contests. Where a section applies only to a particular group, we say so.

SECTION 2 - INFORMATION WE COLLECT

Information you provide directly. When you register as a Director, we collect your name, business name, email address, and account credentials. When you set up a contest, you may provide contestant names, contestant email addresses, contestant phone numbers, photos, and descriptive information about your contest.

Information collected from voters. When you vote or purchase votes, we collect the name, email address, and phone number you provide at checkout, along with details of the votes you cast and the contestant you voted for. When you opt in to text-message updates, we collect and store your mobile phone number.

Payment information. Payments are processed by our third-party payment partners (Stripe, Square, and PayPal). Your full payment card details are collected and processed directly by those partners and are not stored on our servers. We retain transaction records such as amount, date, the last portions of a confirmation the processor returns to us, and the associated contest and contestant.

Information collected automatically. When you use the Service, we automatically collect certain information such as your device and browser type, IP address, and the pages you interact with, including tracking parameters that identify how you reached a voting page (for example, an email link, a text-message link, or a share link). We use this information to understand and improve how the Service is used.

SECTION 3 - HOW WE USE YOUR INFORMATION

We use the information we collect to operate the Service, including to: create and manage Director accounts and contests; process vote purchases and record vote totals; display contestant rankings; send transactional and status communications by email and text message; send contestants and voters updates about contests they have entered or voted in; provide Directors with reports and analytics about their own contests; detect, prevent, and respond to fraud, abuse, and security incidents; and comply with our legal obligations.

SECTION 4 - TEXT MESSAGES (SMS)

If you opt in to text-message notifications (for example, our CyberTracker rank-change alerts or voter updates), you consent to receive recurring automated text messages about the contest to the number you provided. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and you can reply HELP for assistance. We store your phone number and your opt-in and opt-out status to honor these preferences. We do not sell mobile phone numbers, and mobile opt-in data is not shared with third parties for their marketing purposes.

SECTION 5 - HOW WE SHARE YOUR INFORMATION

We share personal information only as described in this policy:

With contest Directors. If you vote in or are entered into a contest, the relevant Director can see information associated with that contest, which may include your name, email address, phone number, and voting activity. Each Director is independently responsible for how they use that information.

With service providers. We share information with third parties that perform services on our behalf, including our payment processors (Stripe, Square, PayPal), our email delivery provider (Amazon SES) and, where applicable, transactional email providers, and our text-messaging provider (Twilio). These providers are permitted to use your information only to provide services to us.

For legal reasons. We may disclose information to comply with applicable law or a valid legal request, to enforce our Terms of Service, or to protect the rights, property, or safety of Dempsi, our users, or others.

Business transfers. If Dempsi is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

We do not sell your personal information.

SECTION 6 - COOKIES AND LOCAL STORAGE

We use cookies and similar browser storage technologies to keep you signed in, remember your preferences, and understand how our voting and referral links are used. You can control cookies through your browser settings, though disabling them may affect some features of the Service.

SECTION 7 - DATA RETENTION

We retain personal information for as long as needed to provide the Service, maintain contest and transaction records, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

SECTION 8 - YOUR RIGHTS AND CHOICES

Depending on where you live, you may have the right to access, correct, or delete the personal information we hold about you, and to object to or restrict certain processing. You can unsubscribe from marketing and status emails using the unsubscribe link in those messages, and you can opt out of text messages by replying STOP. To make a request regarding your personal information, contact us at support@dempsi.com. We will respond consistent with applicable law. Because much of the information we hold is provided by and controlled by contest Directors, we may direct you to, or coordinate with, the relevant Director to fulfill a request.

SECTION 9 - SECURITY

We take reasonable measures to protect your personal information from loss, misuse, and unauthorized access. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

SECTION 10 - CHILDREN’S PRIVACY

The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can delete it.

SECTION 11 - THIRD-PARTY LINKS

The Service may contain links to third-party websites and services that are not operated by us. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.

SECTION 12 - CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Service after any change constitutes your acceptance of the updated policy. We encourage you to review this page periodically.
